1. General Provisions

1.1. These Terms and Conditions (hereinafter referred to as the "Agreement") govern the relationship between the Service Administration and the User when using the AI Fit Expert Telegram bot (hereinafter referred to as the "Service").

1.2. By using the Service, the User confirms that they have read this Agreement and accept all its terms in full.

1.3. If the User does not agree with the terms of the Agreement, they must immediately stop using the Service.

1.4. The Administration reserves the right to modify the terms of this Agreement at any time. The new version comes into force upon publication. Continued use of the Service after changes are made means the User agrees to the new terms.

2. Definitions

Service — AI Fit Expert Telegram bot that provides style and clothing analysis services using artificial intelligence technologies.

User — an individual using the Service through the Telegram messenger.

Administration — the entity managing and providing technical support for the Service.

Credits — the internal virtual currency of the Service required to use image analysis features.

Analysis — processing of an image uploaded by the User using artificial intelligence and providing styling recommendations.

3. Service Description

3.1. The Service provides Users with the ability to receive automated clothing style analysis based on uploaded photos using artificial intelligence technologies.

3.2. To use the Service, the User must have an active Telegram messenger account.

3.3. Main Service features:

  • Analysis of clothing and outfit photos
  • Personalized styling recommendations
  • Analysis history storage
  • Style preference profile management

3.4. Credits are required to use analysis features, which the User obtains:

  • For free upon first use of the Service (for testing)
  • By purchase using Telegram Stars

4. Terms of Use

4.1. The User agrees to:

  • Provide accurate information
  • Not use the Service for illegal purposes
  • Not upload images containing pornography, violence, extremism propaganda, or other prohibited content
  • Not attempt to disrupt the Service or gain unauthorized access to its features
  • Not upload images of third parties without their consent

4.2. The Administration has the right to:

  • Limit or terminate User access to the Service in case of violation of the Agreement terms
  • Change the Service functionality without prior notice
  • Suspend the Service for technical maintenance

4.3. There are no age restrictions. However, Users under 18 years of age should use the Service with parental or legal guardian consent.

5. Payments and Credits

5.1. Credits are purchased through Telegram's built-in payment system (Telegram Stars).

5.2. All payments are processed by the Telegram platform. The Administration does not have access to the User's payment data.

5.3. The cost and quantity of Credits in packages are specified in the Service and may be changed by the Administration unilaterally.

5.4. After successful payment, Credits are added to the User's account within a few minutes.

5.5. Unused Credits are automatically forfeited if the User has no activity in the Service (including analysis requests, profile settings changes, and other interactions with the bot) for 6 (six) consecutive months. Forfeited Credits are not restored when Service use is resumed.

5.6. Credits are indivisible, non-transferable, and cannot be exchanged for money.

6. Refunds

6.1. Purchased Credits are non-refundable as they are digital content provided immediately after payment.

6.2. Before making a purchase, each new User receives free Credits to test the Service functionality.

6.3. If the User is dissatisfied with the quality of the Analysis received, they may contact support via our Telegram bot within 3 (three) calendar days of receiving the result.

6.4. Each complaint is considered individually. The Administration may, at its discretion:

  • Return used Credits to the User's account
  • Provide additional free Credits
  • Refuse to satisfy the complaint if there are justified reasons

6.5. Refunds to payment details are made in exceptional cases at the Administration's decision and only within the technical capabilities of the Telegram platform.

7. Personal Data Processing

7.1. When using the Service, the Administration processes the following personal data:

  • Telegram identifier (User ID)
  • Username, if specified
  • First and last name from Telegram profile
  • Date of first interaction with the Service
  • Service usage history

7.2. Personal data processing is carried out in accordance with the General Data Protection Regulation (GDPR) and applicable European data protection laws.

7.3. The purposes of personal data processing are:

  • Providing access to Service features
  • User technical support
  • Service quality improvement
  • Notification about new features (with User consent)

7.4. The Administration does not transfer personal data to third parties without User consent, except as required by applicable law.

7.5. The User has the right to request deletion of their personal data at any time by contacting support.

8. Image Storage and Processing

8.1. Images uploaded by the User are stored on Service servers for 7 (seven) calendar days from the upload date.

8.2. Image storage purposes:

  • Technical support provision
  • Complaint and dispute resolution
  • Ability to review analysis results again

8.3. After 7 days, images are automatically deleted without possibility of recovery.

8.4. User images are not transferred to third parties and are not used for marketing or advertising purposes without the User's written consent.

8.5. Third-party artificial intelligence services are used to process images. Image transmission is carried out via secure protocol and is governed by the privacy policy of the respective provider.

8.6. The User may request early deletion of their images by contacting support.

9. Limitation of Liability

9.1. Recommendations provided by the Service are for informational and advisory purposes only and do not constitute professional stylist consultation.

9.2. The Administration is not liable for:

  • User decisions made based on Service recommendations
  • Technical failures caused by the Telegram platform or AI service providers
  • Service unavailability due to reasons beyond the Administration's control
  • Any direct or indirect losses resulting from use or inability to use the Service

9.3. Analysis results are generated automatically using artificial intelligence and may contain inaccuracies. The Administration does not guarantee absolute accuracy and applicability of recommendations.

9.4. The maximum liability of the Administration to the User is limited to the amount paid by the User for Credits within the last 30 days.

9.5. The Service is provided "as is" without any express or implied warranties.

10. Intellectual Property

10.1. All rights to the Service, including source code, design, text materials, and trademarks, belong to the Administration.

10.2. Use of Service materials without written permission from the Administration is prohibited.

10.3. Analysis results (text recommendations) are provided to the User for personal use and may not be used for commercial purposes without the Administration's consent.

11. Prohibited Actions

11.1. When using the Service, it is prohibited to:

  • Upload images that violate applicable laws or regulations
  • Use automated means for mass image uploads
  • Attempt to bypass the payment system or obtain Credits illegally
  • Distribute malware through the Service
  • Impersonate other persons or organizations
  • Use the Service for spam or unsolicited messages

11.2. Upon detection of violations, the Administration has the right to immediately block User access to the Service without refund.

12. Force Majeure

12.1. The parties are released from liability for non-performance of obligations caused by force majeure circumstances, including:

  • Natural disasters
  • Military actions
  • Acts of government authorities
  • Technical failures in public networks
  • Actions of third parties, including hacker attacks

13. Applicable Law and Dispute Resolution

13.1. This Agreement is governed by the laws of the jurisdiction where the Service Administration is established, in compliance with applicable European regulations.

13.2. All disputes arising in connection with the use of the Service are resolved through negotiation.

13.3. If it is impossible to resolve a dispute through negotiation, it shall be submitted to the competent court in accordance with applicable law. For Users located in the European Union, disputes may also be referred to the competent authorities or alternative dispute resolution bodies as provided by EU regulations.

14. Final Provisions

14.1. This Agreement comes into force from the moment the Service is first used and is valid indefinitely.

14.2. The User has the right to stop using the Service at any time.

14.3. All notifications and messages are sent through the Telegram bot functionality or to the contact method specified in the "Contact Information" section.

14.4. If any provision of this Agreement is deemed invalid, the remaining provisions retain their legal force.
